Tinley Park Drivers Under 21: Any Alcohol Can Cost Your License

For a Tinley Park driver under 21, a test showing any alcohol above 0.00 can suspend the license, even though 0.08 is the adult limit. A DUI arrest here is heard in Cook County at Bridgeview or in Will County at Joliet, by where the arrest happened.

The under 21 rule

Illinois has a separate suspension for drivers under 21 in 625 ILCS 5/11-501.8. A driver that age is deemed to have consented to chemical testing if arrested on a Uniform Traffic Ticket for any Vehicle Code violation, when the officer has probable cause to believe the driver consumed any alcohol. This is not limited to DUI tickets. The officer must warn the driver that refusing, or testing above 0.00, may cost the license.

What happenedWaiting period before restoration
Test showed alcohol above 0.003 months
Refused or did not complete the test6 months

Those periods are in 625 ILCS 5/6-208.2(a). The same statute lists longer periods for repeat cases.

If the driver is under 18

For a teen holding an instruction permit or a graduated license, the Secretary of State's reports under the DUI suspension law are made available to a parent or guardian, whether or not a suspension is in effect (625 ILCS 5/11-501.1(e)). A parent may therefore hear of it from the state first. Jeff talks with the parent and the young driver, and the underage DUI page explains how these cases are handled.

A monitoring device driving permit is not available under 18 either (625 ILCS 5/6-206.1(a)). Plan for school and work without it.

Which court

Tinley Park lies partly in Cook County and partly in Will County. A Cook County arrest is heard at the Fifth Municipal District in Bridgeview, where Jeff already handles Tinley Park matters. A Will County arrest is heard at the Will County Courthouse in Joliet. The Tinley Park Police Department made the stop. Read the court line on the citation.

What the officer must say, and what comes back

A driver under 21 gets an extra warning on top of the standard one: if the test shows alcohol above 0.00 but under 0.08, a suspension under sections 6-208.2 and 11-501.8 will follow (625 ILCS 5/11-501.1(c)). The statute adds that those results are usable only in proceedings directly related to the incident for which the test was requested. Jeff reads the form the officer used and the order of what was said.

Driving during the suspension

The Secretary of State may issue a restricted driving permit to a driver under 21 after at least 30 days of a first suspension under 11-501.8, and after at least 12 months for a second or later one (625 ILCS 5/6-208.2(e), (f)). For a driver under 18, the state may also require a driver remedial education course and a retest before a license is reissued. Any time served on the under 21 suspension is credited toward the minimum revocation if the driver is later convicted for the same incident (6-208.2(d)).

The permit is not automatic. It is something to ask about in the first call, when there is still time to plan around school and a job.

What families ask

Can a first-time young driver keep a clean record? The answer depends on facts and on the outcome, and Jeff does not promise it. The first offense DUI page and court supervision page describe how first cases often move, and the sealing and expungement page describes what can be done later. The summary suspension page covers the adult rules for comparison.
