What day 46 means

The notice is usually handed to you at the time of arrest. The suspension does not start that day. It takes effect on the 46th day after the notice, whether or not your criminal case has had its first court date.

For a first offender, the suspension is 6 months if you failed the test and 12 months if you refused it. The rules for repeat offenders are longer.

What day 90 means

You can ask the court for a hearing to rescind the suspension. You must make that written request within 90 days after the notice. Asking for a hearing does not pause the suspension, so the sooner it is filed, the better.
