Arrested for DUI by the Illinois State Police?

After a State Police DUI arrest, the court depends on the county where the trooper stopped you, not on which post the trooper works from. A stop on an interstate in Will County goes to the Will County Courthouse in Joliet. The license suspension begins on the 46th day after notice, no matter the county. Jeff McCarthy handles DUI cases in Will County.

Troop 3 covers nine counties

The Illinois State Police site assigns Will County to Troop 3, along with Cook, DeKalb, DuPage, Grundy, Kane, Kendall, Lake and McHenry. It says Troop 3 troopers patrol I-55, I-80, I-57, I-355, I-290 and IL-53, plus many rural and unincorporated areas of those counties.

That spread is the first thing to sort out. Two arrests on the same night, one on I-80 in Will County and one on I-290 in Cook County, belong to different courts even if the same troop made both.

The Joliet post has a Lockport address

The troop page lists a headquarters it calls Joliet, at 16648 S. Broadway St., Lockport, IL 60441. The phone is (815) 726-6377. The public lobby is open Monday to Friday, 8:00 a.m. to 3:00 p.m., excluding holidays.

Jeff's office is in Lockport as well, at 136 E 9th St.

Which court hears a trooper's arrest

A DUI is heard in the county where the arrest happened. For Will County that is the Will County Courthouse, 100 W Jefferson St, Joliet. For a stop in another county, it is that county's courthouse. For the Cook County south suburbs, our other pages use the Fifth Municipal District courthouse at 10220 S 76th Ave in Bridgeview. Look at the county named on your citation or notice before you plan a trip.

Bond

The State Police site does not post a bond process. Illinois no longer uses cash bail; the Will County Sheriff page explains the statutes. What actually happens at the post or the county jail on the night of your arrest is something to ask about directly.

Your car after a trooper's arrest

The State Police website has no tow or impound page that applies to a DUI arrest. Ask the post, at the number above, which tow company took the vehicle. Then call the company about its release hours and its charges. The tow bill is separate from anything the court does, and storage usually adds up by the day.

What to have in hand for the first call

  • The citation or notice, with the county written on it.
  • The date and time of the stop, and the interstate or road.
  • Any paper that names the tow company.
  • The notice of suspension, if you were given one.

With those four items Jeff can tell you which courthouse, which dates, and what is already running.

The 46th day

625 ILCS 5/11-501.1(g) says the statutory summary suspension takes effect on the 46th day after notice was given. Count from the date on the notice. The deadline calculator does the counting for you.

FAQ

Questions people ask about illinois state police

Short answers first. Jeff McCarthy reviews every answer on this page.

No special state court exists for it. A DUI goes to the circuit court of the county where you were arrested. For Will County, that is the courthouse in Joliet.

The troop page lists a Joliet headquarters at 16648 S. Broadway St. in Lockport, phone (815) 726-6377. Lobby hours are Monday to Friday, 8:00 a.m. to 3:00 p.m.

Ask the post who towed the car and call that company.

The charge and the license rules are the same. What changes is the county and the paperwork. Jeff reads the report, whoever wrote it.
